다단계판매 조직을 운영하며 하위 판매원 모집에 수당을 지급한데 이어 신규 판매원에게 가입비나 샘플구입비 등을 과다하게 받은 워너비데이터가 영업정지와 고발 조치됐다.

공정거래위원회는 워너비데이터의 방문판매업 위반행위에 대해 시정명령(행위중지명령,향후금지명령,공표명령) 및 영업정지 명령을 부과하고 법인 및 대표이사를 검찰에 고발하기로 했다고 2일 밝혔다.

공정위에 따르면 워너비데이터는 다단계 판매조직을 이용해 화장품,건강기능식품 등을 판매하면서 하위 판매원을 모집한 추천인에게 추천수당 및 직급수당 등을 지급했다.

추천수당으로 구좌당 5~10만원,신규 판매원의 가입비 70%,하위 판매원의 샘플구입비 70%를 추천인에게 장려금으로 지급하는 방식이었다.

또한 워너비데이터는 신규 판매원에게 가입 조건으로 가입비 11만원을 부과했고,fm 포파나판매원의 총 수익 30%에 대해 의무적으로 샘플(판매 보조 물품)을 구매하도록 강요했다.

방문판매 등에 관한 법률 시행령은 가입비 명목의 법정 한도 금액은 1만원으로,판매 보조 물품 구입 명목의 법정 한도 금액은 3만원으로 각각 규정하고 있다.

공정위는 하위 판매원 모집 자체에 대해 경제적 이익을 지급한 행위,fm 포파나가입비 등의 명목으로 금품을 징수한 행위 등이 방문판매법을 위반했다고 판단하고 영업정지,fm 포파나검찰 고발 등 강도 높은 제재를 결정했다.

다만 영업정지 기간 동안에도 환불 등 소비자 피해구제를 위한 영업활동은 제한하지 않기로 했다.

공정위는 앞으로도 다단계판매 분야에서의 소비자 피해를 방지하기 위해 불법 다단계 영업행위 등 법 위반행위를 지속적으로 감시하고 위법 사항을 적발할 경우 엄중 제재한다는 방침이다.
