[서울=뉴시스]황재희 기자 = 바이오의약품 CDMO(위탁개발생산) 기업 삼성바이오로직스가 고의 분식회계 의혹과 관련해 금융위원회 산하 증권선물위원회(증선위)를 상대로 낸 1심 소송에서 승소했다.

삼성바이오로직스는 이 같은 결정이 나온 14일 “아직 판결문을 수령하지 못한 상태로 공식 입장은 없다"고 밝혔다.

서울행정법원 행정3부는 이날 삼성바이오로직스가 증선위를 상대로 낸 시정요구 등 취소 청구 소송에서 원고 승소 판결을 내렸다.

재판부는 판결문을 통해 “사업보고서 거짓기재 보고 등 일부 회계 처리는 정상적으로 보기 어려워 처분 사유가 존재한다고 인정되지만,인정되지 않은 처분 사유도 함께 존재한다는 점에서 전부 취소가 타당하다”고 판시했다.

앞서 삼성바이오로직스는 고의로 회계기준을 누락했다는 금융당국의 판단에 반발해 2018년 11월 행정소송을 제기한 바 있다.
