(서울=뉴스1) 김진환 기자 = 서울대학교 정문/사진=뉴스1대학생들이 코로나19로 수업이 제대로 진행되지 못했다며 등록금 반환 청구 소송을 제기했지만 패소했다.

서울중앙지법 제31민사부(부장판사 김상우)는 27일 서울대·인천대 재학생 357명이 대한민국과 소속 대학을 상대로 제기한 등록금 반환 청구 소송에서 원고 패소 판결했다.

재학생들은 코로나19 유행 이후 첫 학기인 2020년 1학기 수업 당시 비대면 수업방식이 실시되거나 병행되면서 수업이 부실하게 제공됐다며 소송을 냈다.원고들은 학습권이 침해되고 재학 계약에 대한 의무가 잘 지켜지지 않았다고 주장했다.이들이 청구한 금액은 1인당 등록금 일부인 50만원씩으로 합치면 약 2억4050만원이다.

하지만 재판부는 "비대면 수업방식 또는 병행 수업방식을 실시했다는 것만으로는 부실한 수업을 제공해 학습권을 침해했다고 보기 어렵다"며 "당시의 코로나19 상황을 고려하면 수업 방식의 위법성이나 피고들의 귀책 사유를 인정하기 어렵다"고 밝혔다.

재판부는 "비대면 수업방식 또는 병행 수업방식으로 교육 서비스를 제공한 이상 피고들의 교육 서비스 제공 의무가 이행불능되었다고 볼 수 없다"라고도 밝혔다.
