이재명 전 더불어민주당 대표가 2일 서울중앙지법에서 대장동·성남FC·백현동 관련 배임·뇌물 혐의 재판에서 오전만 출석하고 오후엔 불출석했다.

검찰은 이에 대해 반발했다.검찰 측은 "피고인이 임의로 판단해서 참석하고 안 하고 할 수 있는 것이 아니다"라며 "이 사건에도 동일하게 진행돼야 한다"고 반발했다.

이어 "피고인이 재판부 허락 없이 불출석을 반복하는 것이 허용돼서는 안 된다는 입장"이라며 "허가 없이 불출석이 반복되는 경우에는 정상적 기일이 진행될 수 없다.기본 원칙을 준수할 수 있도록 필요한 조치를 해달라"고 말했다.

검찰의 반발에 이 전 대표 측 변호인은 "국회 공식 일정으로 이번 회기 첫 대정부질문이 있다"며 "기일 외 증거조사로 가능하기 때문에 재판 절차에 차질을 빚지 않기 때문에 요청을 드린 것"이라고 답했다.

재판부는 "피고인이 안 나오면 재판이 원칙적으로 진행되지 않는 게 맞지만 재판이 너무 지연될 것 같아서 양측이 이의제기하지 않고 기일 외 증인신문을 하겠다고 하면 진행하겠다고 한 것"이라며 "(불출석을) 허가하고 용인하는 입장은 아니다"고 밝혔다.
