대법원 판례에 공소장 변경.16억 원→17억 원

서류 조작을 통해 토지 보상금을 가로채 구속 기소된 전 천안시청 청원경찰의 횡령액이 증가했다.

24일 대전지법 천안지원 제1형사부(재판장 전경호)는 특정경제범죄 가중처벌 등에 관한 법률(사기) 등의 혐의로 구속 기소된 A 씨(40) 등에 대한 검찰의 공소장 변경 신청을 허가했다.

검찰은 당초 A 씨를 통해 마을 주민에게 지급된 합법적인 보상액을 제외한 16억원으로 기소했지만‘정상적인 보상금을 편취 금액에서 제외하면 안된다’는 대법원 판례에 따라 공소장을 변경했다.

이에 따라 A씨가 천안시로부터 횡령한 금액은 16억 원에서 17억여 원으로 증가했다.

공소장이 변경에 따라 이날 예정됐던 선고는 다음달 22일로 연기됐다.

한편,에이치에스씨청원경찰 신분으로 시청 건설도로과에서 근무하던 A씨는 지난해 서류를 허위로 작성해 천안시로부터 23차례에 걸쳐 보상금 17억 원을 받아 가로챈 혐의다.

농업에 종사하는 60~70대 주민들은 토지 보상 서류 등을 A씨에게 전달했으며 특히,에이치에스씨한 주민은 보상금 지급을 대가로 1500만 원의 뇌물을 건네기도 했다.
