재판부 협박혐의 유죄 인정 반면 스토킹 행위 무죄 판단

성관계 영상을 퍼뜨릴 듯한 글을 적은 쪽지를 승용차에 붙인 40대가 징역형을 선고받았다.

춘천지법 형사2부(김성래 부장판사)는 협박과 스토킹 처벌법 위반 혐의로 기소된 A씨(41)에게 징역 1년에 집행유예 2년을 선고했다고 지난 30일 밝혔다.

A씨는 지난해 6월 피해자 B씨 승용차 운전석 문에‘들었지?그놈한테 동영상 있다는 거,motogp standings혼자 보긴 참 아까워,motogp standings우린 생각보다 가까이에 있다’는 등 두사람간 성관계 동영상을 유포할 듯한 내용을 적은 메모지를 붙여 협박한 혐의로 재판에 넘겨졌다.

메모지를 붙인 뒤 B씨가 차량에 붙은 메모지를 확인하고 차량에 탑승하는 모습을 그 인근에서 지켜봄으로써 피해자의 의사에 반한 스토킹을 한 혐의도 공소장에 포함됐다.

재판부는 협박 혐의는 유죄로 인정했으나 스토킹 처벌법 위반 혐의는 지속성이나 반복성이 없어 스토킹 범죄에 해당하지 않는다고 판단했다.

재판부는 “피고인은 과거 피해자를 상대로 특수재물손괴죄를 범행 처벌받았음에도 피해자를 협박해 죄책이 무겁다”며 “피해자는 상당한 불안감과 공포심을 느꼈을 것으로 보인다”고 양형 이유를 설명했다.
