이번 헌재 판단에 따라 윤석열 대통령 탄핵심판 일정에도 변수가 생겼습니다.

마 후보자가 임명돼 윤 대통령 탄핵 심판 사건에 참여하면 선고 시점이 늦춰질 수 있기 때문입니다.

박민경 기자가 보도합니다.

[리포트]

문제는 마은혁 헌법재판관 후보자 임명 시기입니다.

만약,토토 공유 비 타임윤석열 대통령 탄핵심판 선고 이전에 마 후보자가 임명되면 헌재는 마 후보자의 재판 참여 여부를 결정해야 합니다.

마 후보자가 참여하지 않으면 현재 8인 체제로 선고가 내려집니다.

당초 예상된 3월 중순쯤 선고가 내려질 것으로 보입니다.

하지만 참여하면 9인 체제에서 탄핵심판 사건의 결론을 내야 합니다.

이 경우 '변론 갱신' 절차를 거쳐야 합니다.

[차진아/고려대 법학전문대학원 교수 : "지금 그 상태에서는 윤 대통령 탄핵 심판 절차의 결정에 참여할 수가 없거든요.참여시키려면 변론을 다시 열어야 됩니다.변론을 재개한 다음에 변론 갱신 절차라는 것을 거쳐야 합니다."]

즉,마 후보자가 참여한 상태에서 변론을 재개하고 증거 등을 살펴봐야 해서 그만큼 선고 기일은 늦어질 수밖에 없습니다.

변론 갱신은 그간 나온 증언과 증거조사 과정을 모두 녹음파일로 듣는 등의 방식으로 진행되기 때문입니다.

시간을 단축하기 위해 재판장이 핵심 내용만 설명하는 방식인 '간이 갱신'을 할 수도 있는데 윤 대통령 측이 동의하지 않을 가능성이 있습니다.
