한밤중 술에 취해 차를 몰다가 사망사고를 낸 뒤 음주운전을 무마하기 위해 또다시 술을 마신 50대 운전자가 재판에 넘겨졌습니다.

전주지검 형사1부(정보영 부장검사)는 교통사고처리 특례법(치사·치상) 위반 혐의로 구속된 50대 A 씨를 기소했다고 오늘(15일) 밝혔습니다.

A 씨는 지난달 27일 오전 0시 45분쯤 전주시 덕진구 여의동 호남제일문 사거리에서 술을 마신 채 포르쉐 차량을 몰다가 스파크 차량을 들이받아 운전자 B(19) 씨를 숨지게 한 혐의를 받습니다.

사고 충격으로 스파크 차량이 뒤집히면서 조수석에 있던 B 씨의 동갑내기 친구도 머리 등을 크게 다쳐 중환자실에서 치료 중입니다.

B 씨와 친구는 인근에서 운전 연습을 마치고 귀가하다가 변을 당했습니다.

당시 A 씨의 혈중알코올농도는 면허정지 수치 기준인 0.036%로 확인됐습니다.

조사 결과 A 씨는 시속 50㎞로 속도가 제한된 도로에서 시속 159㎞로 차를 몬 것으로 드러났습니다.

그는 현장을 수습하던 경찰이 음주 측정을 하지 않자 치료를 마치고는 다시 술을 마신 것으로 조사됐습니다.

경찰은 뒤늦게 귀가한 A 씨를 상대로 음주 여부를 측정해 그가 '면허 취소' 상태에서 차를 몬 것으로 결론 내렸습니다.

이때는 이미 사고 난 지 2시간 여가 지난 후였습니다.

검찰은 경찰의 지연된 음주 측정이 향후 재판 과정에서 증거로 인정받을 수 없다고 보고,홀덤 원샷운전자의 음주 상태를 사고 당시로 역산해 A 씨의 혈중알코올농도를 공소장에 기재했습니다.

검찰 관계자는 "피고인이 죄에 상응하는 처벌을 받도록 공소 유지에 최선을 다하겠다"며 "앞으로도 인명 피해를 야기한 음주운전 사범에 대해서는 무관용 원칙으로 대응하겠다"고 강조했습니다.
